The ICE I-983 form plays a crucial role in the Optional Practical Training (OPT) process for international students in the United States. This form is designed to ensure that students on F-1 visas receive valuable training that is directly related to their field of study. When completing the I-983, students must outline their training objectives, the skills they hope to gain, and how these experiences will enhance their educational journey. Additionally, the form requires detailed information about the employer, including the company’s commitment to providing a structured training program. It also emphasizes the importance of mentorship and evaluation, as students must identify a supervisor who will guide them throughout their training. By carefully filling out the I-983, students not only comply with immigration regulations but also set the stage for a successful transition from academic learning to professional experience. Understanding the nuances of this form is essential for both students and employers, as it lays the groundwork for a mutually beneficial training relationship.

Documents used along the form

The ICE I-983 form, known as the "Training Plan for STEM OPT Students," is essential for international students seeking to extend their Optional Practical Training (OPT) in STEM fields. However, several other forms and documents often accompany the I-983 to ensure compliance with immigration regulations and to facilitate the training process. Below is a list of these important documents.

  • Form I-20: This is the Certificate of Eligibility for Nonimmigrant Student Status. It confirms that a student is enrolled in an eligible program and is necessary for maintaining F-1 status.
  • Form I-765: This is the Application for Employment Authorization. Students must submit this form to request permission to work in the U.S. during their OPT period.
  • Form I-94: This is the Arrival/Departure Record. It provides proof of a student’s legal entry into the U.S. and indicates their visa status.
  • Employer's Offer Letter: A letter from the employer detailing the job offer, including the position, job responsibilities, and terms of employment. This supports the training plan outlined in the I-983.
  • California LLC 1 form: To establish a Limited Liability Company in California, it is essential to complete the California PDF Forms accurately, ensuring compliance with state regulations and smooth business formation.
  • Job Description: A detailed description of the job duties and responsibilities related to the training. This document should align with the goals set in the I-983 form.
  • Performance Evaluation Plan: This outlines how the student’s performance will be assessed during the training period. It helps ensure that the training is meaningful and beneficial.
  • Compliance Documentation: Any documents that demonstrate the employer's compliance with the training plan and immigration regulations. This may include records of evaluations and training progress.

These documents collectively support the I-983 form and ensure that both the student and employer adhere to the requirements set by U.S. immigration authorities. Proper preparation and submission of these materials can significantly enhance the chances of a successful STEM OPT application.

FAQ

What is the ICE I-983 form?

The ICE I-983 form, officially known as the "Training Plan for STEM OPT Students," is a document that outlines the training and learning objectives for international students who are applying for the STEM Optional Practical Training (OPT) extension. This form is essential for demonstrating how the practical training relates to the student’s field of study and how it will benefit their professional development.

Who needs to fill out the I-983 form?

International students who are on F-1 visas and are seeking to extend their OPT period under the STEM extension must complete the I-983 form. This applies to students who have completed a degree in a designated STEM field and have a job offer from an employer enrolled in the E-Verify program.

What information is required on the I-983 form?

The I-983 form requires detailed information, including:

  1. Student's personal details, including name and SEVIS ID.
  2. Details about the employer, including their name, address, and E-Verify number.
  3. A description of the job and how it relates to the student’s field of study.
  4. Learning objectives and how the training will enhance the student’s skills.
  5. Evaluation and assessment methods for the training program.

How do I submit the I-983 form?

Once completed, the I-983 form must be submitted to your designated school official (DSO) for review and approval. After the DSO has signed the form, it should be kept on file at your school. You do not need to submit it to USCIS, but it is crucial to have it ready in case of an audit or request for information.

What happens if my I-983 form is incomplete?

If the I-983 form is incomplete or lacks necessary details, your DSO may not approve it. This could delay your application for the STEM OPT extension. It's essential to ensure that all sections are thoroughly filled out and that the training plan is clear and comprehensive.

Can I change my training plan after submitting the I-983?

Yes, changes to your training plan can occur after submitting the I-983 form. However, any significant changes, such as a new employer or a major shift in job responsibilities, require you to complete a new I-983 form and submit it to your DSO for approval. Keeping your DSO informed of any changes is crucial to maintaining compliance.

What should I do if my employer is not enrolled in E-Verify?

If your employer is not enrolled in the E-Verify program, you will not be eligible for the STEM OPT extension. You will need to seek employment with an employer who is E-Verify compliant. This requirement is strict, and it’s important to verify your employer’s E-Verify status before proceeding with your application.

How long does it take to process the I-983 form?

The processing time for the I-983 form can vary. Once submitted to your DSO, they will review it and typically respond within a few days. However, the overall processing time for your STEM OPT application, which includes the I-983, may take several weeks once submitted to USCIS. It’s advisable to submit your application as early as possible to avoid any delays.

What should I do if I have more questions about the I-983 form?

If you have further questions or need assistance with the I-983 form, it is best to contact your designated school official (DSO). They can provide guidance specific to your situation and help ensure that your application is complete and compliant with all requirements.
